  On March 23, 2019, the then 43-year-old Master Chen drove a full-time online car-hailing in Changde, Hunan, as usual. But Master Chen did not expect that night to be the last time in his life.

  At about 11 o’clock that night, Yang Mouqi, a 19-year-old boy who was a freshman at a university in Changde, booked Master Chen’s car through the online car-hailing software and was ready to go from Wuling District to Jiangnan District. However, at around 0 o’clock on the 24th, when the car arrived near the Changnan bus terminal on Dahu Road in Jiangnan City, when Yang Mouqi was about to get off, he suddenly took out a knife and stabbed at Master Chen.

After contacting his friend WeChat, Yang Mouqi followed his friend’s advice and went to the local police station to surrender. Eventually, Chen died of heart failure due to a punctured heart.

  On May 9, the People’s Procuratorate of Dingcheng District, Changde City approved the arrest of the alleged offender Yang Mouqi on suspicion of intentional homicide.

  Recently, China News Service reporters learned from the victim’s family, Ms. Tian, that she has received a subpoena from the Changde Intermediate People’s Court, which states that the case will be heard today (3), and the parties should go everywhere for the first court of the criminal trial of the Hanshou County People’s Court.   In fact, before the trial, Ms. Tian and others had attended a pre-trial meeting.   "After the accident, the Yang family only sent us 50,000 yuan for funeral expenses through the police, but they never expressed their apologies, and the procuratorate and the public security organ asked for compensation and would not be present." Ms. Tian told China News Service that since the incident, Yang Mouqi’s family has not visited or apologized.

  At the same time, Ms. Tian told China News Service that she had previously proposed criminal incidental civil compensation to the other party, which totaled more than 800,000 yuan according to the compensation for personal death at that time. But after communicating with the court, she learned that the other party’s parents had no intention of compensation.

  At the same time, the online car-hailing platform company shall ensure that the drivers providing services have legal professional qualifications, and sign various forms of employment contracts or agreements with the drivers in accordance with relevant laws and regulations, according to the characteristics of working hours and service frequency, etc., to clarify the rights and obligations of both parties. When providing online ride-hailing services, provide driver names, photos, mobile phone numbers and service evaluation results, as well as vehicle license plates and other information.

  Online ride-hailing platform companies shall not impede fair competition in the market, and shall not infringe upon the legitimate rights and interests of passengers and social public interests. They shall not engage in unfair price behaviors such as crowding out competitors or monopolizing the market, operating at a price lower than the cost, disrupting the normal market order, and harming the legitimate rights and interests of the state or other operators.   Except for cooperating with state organs in exercising supervision and inspection powers or criminal investigation powers in accordance with the law, online ride-hailing platform companies shall not provide any third party with the names, contact information, home addresses, bank accounts or payment accounts, geographical locations, travel routes and other personal information of drivers, ride-hailing and passengers, and shall not disclose sensitive information related to national security such as geographical coordinates and geographical markers. After information leakage occurs, online ride-hailing platform companies shall promptly report to the relevant competent authorities and take timely and effective remedial measures.

No online car-hailing business services shall be provided in the name of private passenger car sharing. Online car-hailing vehicles and drivers shall not provide operation services through online service platforms that have not obtained business licenses.
