The murder of the Changde Didi driver is in court today, and the family of the deceased: only murder for life

Yang Mouqi, a 19-year-old boy, had suicidal thoughts due to pessimism and misanthropy. When he was riding a car on Didi Network that night, he stabbed the driver, Master Chen, 24 times for no reason, and then surrendered and was detained by the police.
A reporter from China News Service learned from Ms. Tian, the wife of Master Chen, that the case will be tried on the 3rd. Regarding the trial result, Ms. Tian said that only "murder pays for life". However, some lawyers have analyzed that the murderer has been identified as depressed and has surrendered, and is likely not to be sentenced to death.

On March 23, 2019, the then 43-year-old Master Chen drove a full-time online car-hailing in Changde, Hunan, as usual. But Master Chen did not expect that night to be the last time in his life.
At about 11 o’clock that night, Yang Mouqi, a 19-year-old boy who was a freshman at a university in Changde, booked Master Chen’s car through the online car-hailing software and was ready to go from Wuling District to Jiangnan District. However, at around 0 o’clock on the 24th, when the car arrived near the Changnan bus terminal on Dahu Road in Jiangnan City, when Yang Mouqi was about to get off, he suddenly took out a knife and stabbed at Master Chen.

After the attack, Yang Mouqi got out of the car, took out his mobile phone and told his friends on WeChat that he had killed someone. Under the persuasion of his friends, Yang Mouqi came to the public security organ to surrender.
According to the police report issued by the Public Security Bureau of Dingcheng District, Changde City, Hunan Province, after a preliminary investigation by the public security organs, at around 0:00 on March 24, when getting off the bus near the Changnan Bus Terminal on Dahu Road in Jiangnan City, Yang Mouqi, who was sitting in the back row, took advantage of the driver’s unpreparedness and stabbed Chen several times, causing Chen’s death.
Why did a 19-year-old boy kill an unknown online taxi driver for no reason? On May 10, 2019, the Changde Dingcheng District Procuratorate released a specific notice on the case:
Since 2017, Yang Mouqi has had suicidal thoughts because he felt that his life was too dull and tasteless. In December 2018, he bought daggers and gloves online, but he never had the courage to implement them. At about 11 pm on March 23, 2019, Yang Mouqi temporarily decided to kill to test his courage and planned to return to Jiangnan City to implement it again. He made an appointment with the driver Chen on the online ride-hailing platform. In the process of waiting for Chen, he suddenly decided to kill the driver when he reached his destination and then commit suicide.
At 11:40 that night, Yang Mouqi suddenly stabbed Chen with a dagger before arriving at his destination, causing Chen to be stabbed in the neck, chest and other places. After contacting his friend WeChat, Yang Mouqi followed his friend’s advice and went to the local police station to surrender. Eventually, Chen died of heart failure due to a punctured heart.
On May 9, the People’s Procuratorate of Dingcheng District, Changde City approved the arrest of the alleged offender Yang Mouqi on suspicion of intentional homicide.

"Later, there was the surveillance video at the time of the incident, but I didn’t watch it, I didn’t dare to watch it." Now, more than half a year has passed since her husband passed away, but every time she talks about it, her wife, Ms. Tian, still chokes up several times.
In Ms. Tian’s heart, her husband is a good man with a good temper and a good family. In early 2017, considering that the elderly in the family were elderly and the pressure on his wife to take care of the whole family was too great, Master Chen quit his previous job in Guangzhou and returned to his hometown in Changde to work as a driver in a courier company.
In order to supplement the family, Master Chen and his wife planned to continue to work as a ride-hailing driver after get off work to earn some extra money. In this way, in mid-2017, Master Chen took out a loan to buy a used car, started a side business of ride-hailing, and quit his job in October of the same year to become a full-time ride-hailing driver.
"In good times, I can earn 5,000 or 6,000 yuan a month, and my family’s life is a little better." Ms. Tian told the China News Service reporter that the family’s financial burden is not small. The eldest son was 17 at the time, and the youngest son was only 5 years old. His salary was only less than 3,000 yuan. Master Chen was the pillar of the family.
But now, the family’s financial support has collapsed. In addition to missing Ms. Tian, there are also her youngest son, who has not yet attended elementary school, and her eldest son, who is studying for a vocational high school. After learning of his father’s death, the eldest son gradually became taciturn and did not want to hear anyone talk about his father.
Today, Ms. Tian’s parents-in-law still live in the countryside. In order to ease the financial pressure, she moved out of the rental house where she had lived with her husband for 7 or 8 years and went to live with her sister.
"My sister doesn’t charge me a penny, and Lao Chen’s former friends often come to visit and give us some financial subsidies. I am very grateful to them. But days still can’t go back to the past," Ms. Tian said.

The murderer was identified as depressed
The family of the deceased: only seeking the death penalty, but not optimistic about the outcome
Recently, China News Service reporters learned from the victim’s family, Ms. Tian, that she has received a subpoena from the Changde Intermediate People’s Court, which states that the case will be heard today (3), and the parties should go everywhere for the first court of the criminal trial of the Hanshou County People’s Court. Ms. Tian said she will attend the trial with her sister and her mother-in-law.
In fact, before the trial, Ms. Tian and others had attended a pre-trial meeting. At the meeting, Ms. Tian received a "Notice of Appraisal Opinion" issued by the Changde Dingcheng District Public Security Bureau, which showed that the appraised person, Yang Mouqi, was diagnosed with depression and had limited (partial) criminal responsibility for committing harmful acts in this case.
In the face of this appraisal certificate, Ms. Tian wrote an application asking the police to re-identify whether Yang Mouqi suffered from depression and his criminal responsibility, but it was rejected for insufficient reasons.

"In this way, I think the murderer may not be sentenced to death." Ms. Tian said she was pessimistic about the verdict. What also chilled Ms. Tian was that the murderer never apologized to her.
"After the accident, the Yang family only sent us 50,000 yuan for funeral expenses through the police, but they never expressed their apologies, and the procuratorate and the public security organ asked for compensation and would not be present." Ms. Tian told China News Service that since the incident, Yang Mouqi’s family has not visited or apologized.
At the same time, Ms. Tian told China News Service that she had previously proposed criminal incidental civil compensation to the other party, which totaled more than 800,000 yuan according to the compensation for personal death at that time. But after communicating with the court, she learned that the other party’s parents had no intention of compensation.
In addition, in response to the current online rumors that the murderer’s family had asked him to return 10,000 multiple burial expenses, Ms. Tian also responded to China News Network that this statement was untrue, and the other party did not ask for a refund of burial expenses.
In fact, in Ms. Tian’s heart, the amount of compensation is no longer crucial: "We just want the murderer to be sentenced to death, even if it doesn’t cost money." Ms. Tian said bluntly.

The murderer is unlikely to receive the death penalty
On the one hand, the act of stabbing the victim 27 times to death for no reason, and on the other hand, there was a plot of surrender and was identified as depression. Fan Chen, a lawyer at Beijing Jingshi Law Firm, believes: "Yang Mouqi is likely not to be sentenced to death."
Fan Chen analysis believes that, from the results, Yang Mouqi has been diagnosed with depression, and in this case, he was found to have limited (partial) criminal responsibility for committing harmful acts. According to the provisions of the criminal law, he can be given a lighter or reduced punishment.
According to Article 18 of the Criminal Law of the People’s Republic of China on the "capacity of criminal responsibility of special personnel": Mental patients who have not completely lost the ability to identify or control their own behavior shall be held criminally responsible, but the punishment may be lighter or reduced.
"Obviously, according to the appraisal results, Yang Mouqi was found to have limited (partial) criminal responsibility when committing harmful acts, which meets the above legal requirements." Fan Chen explained, adding the circumstances of surrender, and if the family understands, the sentence can be moderately reduced.
But in Ms. Tian’s view: "Although he turned himself in and was diagnosed with depression, he still felt that this was not enough to mitigate his crime, and he also believed in the justice and fairness of the law."
